Terms of Use
Last updated: 2 November 2026
These Terms of Use (the "Terms") govern your use of the Crypto Tax website and service (the "Service"), operated under the name Crypto Tax ("we", "us"). Creating an account, or buying or using the Service, means you have read and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. The Terms are written in the masculine form for convenience only and apply equally to everyone.
The Service
- Crypto Tax lets you import your cryptocurrency activity from exchanges, by uploading an export file or connecting a read-only API key, and calculates capital gains and losses under Israeli tax law: FIFO cost basis, inflation (CPI) indexation under section 88 of the Income Tax Ordinance, offsetting of losses including losses carried forward from earlier years, and the statutory corporate tax rate for a company. It then generates a report and a Form 1399 appendix for you to file.
- The Service also offers accountants and tax advisors tools to prepare reports for their clients.
Who may use it
- You must be at least 18 and legally able to enter into a binding agreement. If you register a company, you confirm that you are authorized to act for it.
- The calculations assume the filer is an Israeli tax resident. The Service is not suitable for anyone else.
Your account
- Give accurate details, and keep them up to date. Your name and account type appear on your reports.
- Keep your password and access to your email account secure, since a sign-in code is sent there. You are responsible for what happens in your account. Tell us immediately if you suspect unauthorized use.
- One account per person or company. An account may not be transferred.
Accountants and tax advisors
- An accountant account may add clients and prepare reports for them after we approve the account.
- By adding a client, you confirm that you are authorized by them to do so, that you have their consent to upload their information, and that you have informed them of our Privacy Policy. You are responsible for the accuracy of what you enter and for how you use the reports.
- Clients cannot sign in. Everything done for them is done through your account, and recorded in their activity log.
Exchange API keys
- Connect only keys with read-only permission. We refuse a key that can withdraw funds, and stop syncing a key that gains that permission. You are responsible for the permissions of the keys you create, and should restrict them on the exchange.
- You can remove a key at any time. Removing it here does not revoke it on the exchange: do that there too.
- Exchanges' APIs do not always return a complete history. After every sync we compare the exchange's balances with the imported history and show any gap, but completeness remains your responsibility.
Not tax, legal or investment advice
- The Service is a calculation tool. It is not a substitute for an accountant, tax advisor or lawyer, and nothing in it is advice. We are not licensed tax advisors or accountants.
- Every figure is calculated automatically from the data you provide. No one reviews your report before you download it, so it is only as complete and accurate as the data you import. Missing, duplicated or misclassified transactions lead to wrong results.
- The calculation has known limits. It does not calculate the surtax (מס יסף). It prices each transaction by the exchange rate and market data sources described in the Service (Binance spot prices, the Bank of Israel representative rate, and the CPI published by the Central Bureau of Statistics), which may differ from other acceptable sources. Some kinds of activity, such as staking and other rewards, airdrops, futures, margin and loans, raise tax questions without a settled answer, and the Service applies one reasonable interpretation of them.
- The Service and its reports have not been approved by the Israel Tax Authority, unless we say so explicitly.
- Review every report, and consult a qualified professional before filing. You alone are responsible for your tax filings and their consequences.
Prices and payment
- You pay per tax year report. Tax year reports can be bought in any quantity, provided one purchase costs no more than ₪40,000, VAT included. One tax year report unlocks one tax year for one filer (you, or one of your clients) permanently. After that you can regenerate that year's report as often as you like at no extra charge. Tax year reports you have bought do not expire.
- Prices are shown in shekels, excluding VAT. VAT at the rate in force is added at checkout, and the total is shown before you pay.
- Payment is made on the secure payment form of Morning (Green Invoice), by the methods offered at checkout. A tax invoice/receipt is issued for every payment and sent to your email.
- A card payment can be split into up to 6 installments. A purchase over ₪20,000, VAT included, can be paid by card only, in 2 to 6 installments.
- We may change prices. A change does not affect tax year reports you have already bought.
Cancellation and refunds
- You may cancel a purchase within 14 days of making it, provided that none of the tax year reports bought in it has been used, by writing to [email protected]. A cancellation fee of 5% of the amount paid or ₪100, whichever is lower, as set by the Consumer Protection Law, is deducted from the refund. The refund is made to the card you paid with within 14 days of the cancellation request.
- A purchase in which any tax year report has been used cannot be cancelled: the report generated is information delivered to you as soon as it is produced. After 14 days a purchase cannot be cancelled.
- If a report cannot be generated because of a fault on our side, the tax year report is returned to your balance automatically.
Your data
- The files and data you upload remain yours. You give us permission to store and process them only to provide the Service to you, as our Privacy Policy describes.
- You confirm that you have the right to upload the data you provide, and that doing so does not breach any law or anyone's rights.
Acceptable use
- Do not use the Service for any unlawful purpose, or to prepare a false or misleading report.
- Do not try to gain access to other accounts or to our systems, bypass security or usage limits, run automated scraping, overload the Service, upload malicious files, or copy, reverse-engineer or resell the Service.
- We may suspend or close an account that breaches these Terms, and block regeneration of a report whose underlying transactions were changed in a way that suggests misuse, pending review.
Intellectual property
- The Service, its software, design, texts and brand belong to Crypto Tax. You may use them only as part of normal use of the Service. The reports you generate are yours to use for your own tax affairs, or your clients'.
Third-party services
- The Service relies on third parties, such as exchanges, the payment processor, Google sign-in, and public data sources for prices, exchange rates and the CPI. Their services are subject to their own terms. We are not responsible for their availability or accuracy, or for changes they make.
Availability and changes
- We work to keep the Service available and correct, but do not promise it will be uninterrupted or error-free. We may change, add or remove features, and will give reasonable notice of a significant change that affects you.
- Download and keep a copy of every report you file. If the Service is discontinued, we will give reasonable notice so you can download your data.
Disclaimer
- The Service is provided "as is" and "as available". To the extent the law permits, we make no promise that it suits your particular needs, or that any report will be complete, correct or accepted by the tax authorities.
Limitation of liability
- To the extent the law permits, we are not liable for indirect or consequential damage, including tax, interest, linkage differences, fines, or loss of profit or data, arising from use of the Service or reliance on a report.
- Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to it.
- These limits do not apply to damage caused by our malice or gross negligence, or where the law does not allow liability to be limited.
Indemnity
- If a third party makes a claim against us because of your breach of these Terms or of any law, including information you uploaded about a client without authority, you will indemnify us for our reasonable costs of dealing with it, after we notify you and allow you to defend against it.
Ending use
- You may stop using the Service and delete your account from Settings at any time. Unused tax year reports are not refunded on deletion, except as set out under "Cancellation and refunds".
- We may suspend or close your account if you breach these Terms, if the law requires it, or to protect the Service or other users. Where possible we will notify you first and let you download your data.
Changes to these Terms
- We may update these Terms. The date at the top shows when they last changed. When a change is significant, you will be asked to read and accept the updated Terms the next time you sign in. A change does not apply retroactively to purchases already made.
Governing law and jurisdiction
- These Terms are governed by the laws of the State of Israel. The competent courts in Tel Aviv-Jaffa have exclusive jurisdiction, without derogating from any right a consumer has by law to bring a claim in another court.
General
- These Terms and the Privacy Policy are the entire agreement between us regarding the Service. If a provision is found invalid, the rest remains in force. Not exercising a right is not a waiver of it.
- These Terms are published in Hebrew and in English. If they differ, the Hebrew version prevails.
